Terms of use for self-assessments found in the Product sustainability corner

By using Nemko’s online Self- Assessment tool for evaluating your compliance with global basic product sustainability requirements and best practices (referred to as "the Tool"), you agree to abide by the following terms and conditions (“the Terms”). Please read them carefully before accessing or using the Tool. If you do not agree with the Terms, please do not use the Tool.

1. Acceptance of Terms: By accessing or using the Tool, you acknowledge that you have read, understood, and agreed to comply with the Terms. The terms may be updated periodically, and continued use of the Tool constitutes acceptance of any changes.
2. Limited License: Nemko grants you a non-exclusive, non-transferable, revocable license to access and use the Tool for the sole purpose of assessing your product's compliance with sustainability requirements.
3. Privacy Policy: Your use of the Tool is also governed by Nemko’s Privacy Policy, which outlines how Nemko collect, use, and protect your personal information. Please review our Privacy Policy before using the Tool.
4. Confidentiality of Information: The information you provide during the self-assessment using the Tool will be handled in a confidential manner. We will not share this information with third parties except as required by law or with your explicit consent. The supplier of the technical tool used for processing of the answers given, is [information about quiz-maker]. Quiz-maker does not collect or store information about you as a user.
5. Accuracy of Information: You are solely responsible for the accuracy and completeness of the information provided during the self-assessment using the Tool. We are not liable for any inaccuracies or omissions in the assessment results or any decisions made based on those results.
6. No Warranty: The Tool is provided "as is," without any warranties, express or implied. Nemko does not guarantee the accuracy, completeness, or reliability of the assessment results obtained using the Tool, and Nemko is not responsible for any errors or omissions.
7. Intellectual Property: All content, trademarks, logos, and intellectual property associated with the Tool are the property of their respective owners. You may not reproduce, distribute, modify, or create derivative works based on the Tool without Nemko’s explicit consent.
8. Limitation of Liability: To the extent permitted by law, Nemko shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from or related to the use of the Tool, even if Nemko has been advised of the possibility of such damages.
9. Termination: Nemko reserves the right to terminate or suspend your access to the Tool at any time, without notice, for any reason, including, but not limited to, violation of the Terms or any applicable laws.
10. Governing Law: The Terms are governed by and construed in accordance with the laws of Norway. Any legal action arising out of or relating to the Terms or your use of the Tool shall be filed in the courts of Oslo, Norway.
